After the emotional decision to end your marriage, you may be wondering about your next step. As you may know, Australia does not have what is commonly called quickie divorces. This means you must follow a specific protocol throughout the process.
Separation
Separating from your spouse is your first step in ending your marriage. Your partner does not need to agree with the decision for you to begin the process. You must inform the other party about your decision and act upon it.
Make a note of the day your separation begins. You will need this information to prove the relationship is over when you apply for divorce or property orders.
Arrangements regarding your children are not dependent on when the separation began. You can start this in Family Court at any time.

Separation Under One Roof
You can be separated and living in the same home. However, you must prepare for the court to ask for additional information.
The information must come in the form of an affidavit that explains how and when the relationship ended. It could include details such as
- You have separate bedrooms
- You do not go out together for entertainment
- Your finances are separate
- You do not do household tasks for each other
- You prepare and eat meals separately
- You told friends and family the marriage is over
In addition to your affidavit, the court will want one from an independent person. If you and your partner are filing jointly, a separate affidavit is required.
